Possíveis Reflexos da Lei Geral de Proteção de Dados no âmbito das Relações Coletivas de Trabalho: uma análise a partir da omissão legislativa

Abstract

The present work suggests an analysis, albeit in an incipient way, about the repercussions of Federal Law No. 13,709 / 2018 (General Data Protection Law - LGPD) on collective labor relations. The text begins by addressing the Brazilian legislative omission regarding specific data protection in lato sensu work relations, drawing a parallel with the European Regulation paradigm (GDPR), in order to ascertain whether legislative silence would in any way prevent the reflexes of LGPD in the labor sphere, specifically, collective. In a second step, the first impressions and / or inquiries about the effects of the application of LGPD to collective labor relations are indicated, although not exhaustively and conclusively, but propositional and instigating, given the recent entry into force and production effects of the federal legislation in question.
